Florida Families Sue State Over Alleged Child Welfare System Failures and Abuses

Family members in Florida are taking legal action against the state’s Department of Children and Families (DCF) and Governor Ron DeSantis, alleging that the foster care system has been manipulating evidence and fabricating abuse allegations to keep children away from their biological relatives. The lawsuit, filed in federal court, accuses the system of favoring system-connected individuals over biological family members when placing children in foster care.

One family, the Williams, shared their heartbreaking story of losing custody of their daughter after she was taken by state child welfare workers. Despite no criminal charges being filed against them, the Williams had their parental rights stripped away and their daughter placed with a foster family with ties to the foster care system.

Relatives of the Williams and other families involved in the lawsuit expressed their frustration at being disqualified from taking custody of their loved ones, despite passing extensive background checks and home studies. The lawsuit alleges that caseworkers within the foster care system deliberately ignored state and federal laws requiring children to be placed with biological relatives before non-relative strangers.

Attorney Octavia Brown, a former insider in the foster care system, described the practice as “internal diversion,” where system workers prioritize placing children with individuals connected to the system rather than with their biological families. Brown highlighted the vulnerability of young parents and poor families who may not have the resources to fight false allegations.

The Department of Children and Families responded to the lawsuit by emphasizing their commitment to finding suitable caregivers for children in the foster care system. However, the families involved in the lawsuit are determined to fight for the return of their children and expose what they believe to be a corrupt system that has torn their families apart.

As the legal battle unfolds, the families are hopeful that justice will prevail and bring their children back home where they belong. The Williams’ daughter, raised in a different household, may one day learn the truth about her past and the family that has been fighting to bring her back.
